CIMA Welcomes Supreme Court of Canada Decision In CBC v. SODRAC

CIMA applauds the decision of the Supreme Court of Canada in CBC v. SODRAC.

The Canadian Independent Music Association (CIMA) echoes the applause of our many Canadian music industry colleagues for the Supreme Court of Canada’s recent decision in CBC v. SODRAC.

An important decision for copyright owners and creators, CBC v. SODRAC dealt with the core issue of whether or not so-called ‘broadcast-incidental’ copies of audiovisual programming triggered reproduction rights for the music contained in these programs. Broadcast-incidental copies, also known as ephemeral copies, are copies created solely to facilitate the act of broadcasting internally.

As this case is an important one for the copyright ownership community broadly, and the music industry specifically, CIMA supported SODRAC as interveners alongside organizations like Music Canada, the Canadian Music Publishers Association (CMPA), the Canadian Council of Music Industry Associations (CCMIA), the Canadian Musical Rights Reproduction Agency Ltd. (CMRRA), the Association quebecoise de l’industrie du disque, du spectacle et de la video (ADISQ), and others.

CIMA is pleased that the Supreme Court of Canada upheld the existence of a reproduction tariff on broadcast-incidental copies, ensuring that copyright owners and creators will be properly compensated for the use of their content in audiovisual works.
